Domain Name Dispute Claims
This policy handles issues with our products and services, except for domain names.
For domain name disputes, you'll need to follow the Uniform Domain-Name Dispute-Resolution Policy (UDRP) and file claims with an ICANN-approved arbitrator. For .ng domain names, contact the Nigeria Internet Registration Association (NIRA) and follow their Complaints Policy.
Copyright Claims
If you believe someone is using copyrighted material on our hosting service without permission, you can file a copyright claim. To report the infringement, send an email with "Copyright Claim" in the subject line to reportabuse[at]mokohhost.com. Here's what to include in your email to help us process your claim quickly:
- briefly describe the work you believe is being infringed.
- attach a copy of your copyright registration certificate.
- provide the web address (URL) of the content you believe is infringing your copyright.
- include your full name, address, email address, and phone number.
- if you know the name, address, email, and phone number of the person or entity hosting the infringing material, include that information as well.
- briefly state that you have a good faith belief that the material is not authorized by the copyright owner and that the information in your claim is accurate.
Once we receive your claim, we'll investigate it thoroughly. To protect both parties during the investigation, we might temporarily restrict access to the disputed material. This could involve removing it from our servers or disabling access.
If your claim is valid, we may take permanent action, such as permanently removing the material, suspending the account hosting the material, or taking other appropriate steps. However, if we determine your claim is unfounded, we'll promptly restore access to the material.
Trademark Claims
To alert MokohHost about any trademark infringement or to file a trademark claim, please email us at reportabuse[at]mokohhost.com. Please use "Trademark Claim" as the subject line of your email, and ensure that it includes the following details:
- include your full name, address, email address, and phone number as the trademark owner.
- attach a copy of your trademark registration certificate or acceptance letter.
- briefly describe how you believe your trademark is being misused.
- provide the date you first started using the trademark.
- if you know the name, address, email address, and phone number of the person or entity using your trademark, include that information.
- we also need some evidence to show the alleged infringer is a MokohHost customer. This could be a screenshot of their website hosted on our platform or any other proof that links them to our service.
Upon receiving the provided information, MokohHost will conduct an investigation and pass on the Complaining Party's notification to the alleged infringer. While this investigation is ongoing, we may temporarily restrict access to or remove the suspected infringing material from our website, or take other necessary actions.
If the Complaining Party's claim is found to be valid, we reserve the right to permanently remove, suspend, or restrict access to the infringing material, or take any other appropriate actions. On the other hand, if the claim lacks legitimacy, we will promptly reinstate access to the allegedly infringing material.
Please note that the terms of this Policy do not override the UDPR and the NIRA Complaints Policy, nor do they release MokohHost and its customers from their obligations to adhere to them when necessary.
Challenging Content Takedowns
If you believe we removed or disabled content on your MokohHost account due to a mistake in a trademark or copyright infringement claim, you can file a counter-notification. A counter-notification allows you to dispute the claim and request that your content be restored.
To file a counter-notification, send an email to support[at]mokohhost.com with "Counter-Notification" in the subject line. Here's what to include in your email to help us process your request quickly:
- clearly describe the specific content (like a webpage, image, or document) that was removed or disabled by MokohHost. If possible, include the web address (URL) where the content was located before it was taken down.
- briefly state that the removal or disabling of your content was a mistake. You can mention why you believe it was a mistake, but this section is not mandatory.
- provide your full name, address, email address, and phone number. This will allow MokohHost to easily reach you regarding your counter-notification.
Upon receipt of your Counter Notification, MokohHost will promptly share a copy with the Complaining Party. Furthermore, we will inform them of our intent to reinstate the removed material or cease access restrictions within ten (10) business days.
MokohHost is committed to restoring the material and lifting access restrictions within a maximum of fourteen (14) business days from the Counter Notification receipt, unless prior notice is received from the Complaining Party regarding legal action to restrain the alleged infringer from engaging in the infringing activity associated with the material hosted on MokohHost's system or network.
Continued Copyright Violations
Under certain conditions, MokohHost reserves the right to suspend the accounts of customers who repeatedly breach this policy or infringe upon copyrighted works, trademarks, or any other intellectual property rights.
Changes to this Trademark/Copyright Infringement Policy
We may occasionally update our Trademark/Copyright Infringement Policy. Any changes will be communicated by posting the updated Trademark/Copyright Infringement Policy on this page. In addition, we will notify you through email and/or with a noticeable announcement on our service before the changes take effect. The "Last updated" date at the top of this Trademark/Copyright Infringement Policy will also be revised accordingly. It is recommended to check this page regularly for updates, as changes become effective once posted here.
